The Condo Association Owns:
The entire outside of all buildings from the studs outward, but not the window glass
The attic and roofs of all buildings
The sidewalks, the lawn, the landscaping and the parking lot
All fencing around the complex
All dumpsters on the property
The lobby area of buildings 3052 (first floor) and 3034
Owners who rent are responsible for making sure that their renters know that they only rent the condo unit, not anything that is owned by the Condo Association
Purchasing a condo at Opequon Center mean that you own the unit windows and from the unit studs inward. This includes the studs of the attic space downward. The actual attic space is owned by the Condo Association. Placement of utilities, air handling units and vent pipes is permitted. All penetrations of the drywall must be sealed after the placement of utilities to prevent the spread of fire/smoke. All owners are responsible to make sure that utility placement or air handling units has not damaged the fire protections. Owners will be charged for repair of the draft stopping should it be damaged by running the utilities or air handling units. Owners will be responsible for damage done by Comcast, Verizon, or any other utility or air conditioning company that does work in the Condo Association’s attic even if the owner themselves did not do the damage. Owners are responsible for damage done by their contractor. Owners will be charged for damage repair anytime that the Condo Association discovers the damage. Owners are responsible for damage done by their renters.
Use of Attic Space At Opequon Center
1. Placement of utilities, air handling units and vent pipes is permitted. All penetrations of the drywall must be sealed after the placement of utilities to prevent the spread of fire/smoke. No wood bracing of the roof may be cut for any reason. All owners are responsible to make sure that utility placement or air handling units placement has not damaged the fire protections, nor the structural integrity of the roof. Owners will be charged for repair of the draft stopping or roof structure should it be damaged by running the utilities or air handling units or anything else. Owners will be responsible for damage done by Comcast, Verizon, or any other utility or air conditioning company that does work in the Condo Association’s attic even if the owner themselves did not do the damage. Owners are responsible for damage done by their contractors. Owners will be charged for damage repair anytime that the Condo Association discovers the damage. Owners are responsible for the actions of their renters. Renters are not part of the Condo Association. Owners are responsible for damage done by their renters.
2. Renters must abide by the Condo Associations attic rules. Damage done by renters, either knowingly or unknowingly, will be repaired at owner’s expense.
3. Storage of any material or any other use of the attic space is NOT ALLOWED. Non-functional air handling units must be removed from the attic space or roof, if located there, when they become non-functional. Owners will be charged if the Condo Association has to remove non-functional air handling units.
4. Fire prevention is everyone’s responsibility. Fire safety procedures are minor expenses when compared to replacement of a destroyed building. A fire in one unit could spread to another unit. Once fire reaches the roof, any one of our buildings will be destroyed in less than 20 minutes. It would likely be a year or more before the building could be rebuilt.
